PURCHASE TERMS AND CONDITIONS

YOUR PURCHASE OF THE PRODUCTS AND/OR SERVICES OFFERED HEREIN IS CONDITIONED UPON YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS IN THESE PURCHASE TERMS AND CONDITIONS (“PURCHASE TERMS”). BY COMPLETING YOUR PURCHASE, YOU AGREE TO BE BOUND BY THE PURCHASE TERMS. IF YOU DO NOT AGREE TO THE PURCHASE TERMS, YOU ARE NOT AUTHORIZED TO MAKE THIS PURCHASE.

WEBSITE CONTENT
The content on the website, including but not limited to the products and services offered herein, should not be considered medical advice. You should always talk to your health care provider for diagnosis and treatment, including your specific medical needs. None of the content on this website represents or warrants that any particular service or product is safe, appropriate, or effective for you.
CHARGES
A valid credit card number, expiration date, and card security code is required for all purchases. If we are unable to charge the full cost of your purchase to the credit card you provide, we may cancel your order or request an alternate form of payment.
Optum’s designated credit card processor, TransFirst Health Services, Inc. (“TransFirst”), will collect your credit card information and related personal information for its use in processing your payment for the products and/or services ordered by you. Any complaints or grievances regarding the processing of your payment should be addressed to Optum at 800-864-2188.
You understand that the prices for products and services may be changed from time to time, but that the website will reflect current prices.
RESPONSIBILITY FOR CHARGES AND APPLICABLE FEES
You are solely responsible for all charges and applicable fees (including delivery charges, taxes and any fees assessed by your bank) associated with your order.
FITNESS CLUB SERVICES OR PROGRAMS
You understand that when purchasing any fitness club services or programs, including but not limited to OptumHealth Performance coaching services or programs, you may be required to sign a waiver/agreement prior to beginning any physical activity as part of any such coaching services or programs.
SHIPPING
Optum’s designated service provider, The Paquin Healthcare Companies, Inc. (“Paquin”), will collect your personal information for its use in managing the payment and shipment of your order. All items must be shipped to a street address within the Continental United States only. Optum will not ship items to a P.O. Box. Any complaints or grievances regarding the management of your order, including but not limited to the processing any refund of the products and/or services you ordered, should be addressed to Optum at 800-864-2188.
Standard Shipping and Handling
Optum may ship your items from multiple locations. Accordingly, shipping rates may be calculated after you select your products and finalize your order. Your order is not guaranteed to be delivered within a certain timeframe. Actual shipping times may vary depending on the items ordered and the shipping method you selected. If you order multiple items, they may arrive in multiple shipments. .
Shipping items to a P.O. Box is not recommended. Optum may not be able to deliver to a P.O. Box. You acknowledge and accept any risk associated with shipping to a P.O. Box. You further acknowledge and accept that Optum will not issue a refund for any products that are not deliverable due to the use of a P.O. Box.
Delays
While Optum will make every attempt to fill all orders placed, an order may be delayed or backordered. If a delay or backorder occurs you will receive notification via email. You may request a cancellation for your order, provided that the product(s) you ordered has not shipped. You understand that if you do not contact Optum before the product(s) you ordered is shipped, you will have agreed to the shipment delay.
If Optum cannot deliver your product(s) within thirty (30) days of the order date, delay notice or backorder notification (whichever is greater), a cancellation will be processed automatically by Optum and you will receive a prompt refund for any unshipped portion of your order. Please allow up to two billing cycles for the refund credit to appear on your credit card statement.
RETURNS
Most products are returnable and for those that are, they may be returned to Optum within 30 days of the shipment date for a refund. If you would like to replace the product you have returned, please place a new order. Returned products are subject to the following guidelines:
Defective, Damaged or Misshipped Items
You will receive a full refund from Optum for the product(s) if they are defective, damaged or are otherwise misshipped when you receive them.
Proper Conditions for Return and Credit
Returned merchandise must be in new condition with its original packing and accessories intact or otherwise in the condition it arrived. If you are returning a product listed below, please check to make sure your return meets the conditions described.
- CDs, DVDs, VHS tapes must be unopened.
- Books must be in their original condition.
- Perishables and personal care items may not be returned unless defective or misshipped.
- No personalized items may be returned.
If the product is incorrect or damaged refuse the delivery and you will receive a full refund from Optum. Once a product has been accepted, it will be assumed to be correct and in good working condition. Any issues that arise after the product is signed for must be resolved through the manufacturers warranty that accompanies the product.
To request a Return Authorization Number (“RA Number”) from Optum for an item, please phone: 800-864-2188 (7 AM - 8 PM Central M-F). Optum will need to have your order number and the product(s) you wish to return in order can expedite your request. Returns will not be accepted by Optum without a RA Number. RA Numbers will expire after 10 days, and the product will not be accepted if it is returned after that timeframe. Please include the RA Number on the outside of the shipping package and do not write directly on the manufacturer’s box.
Returning a product(s) may change or void coupon discounts or refunds currently appearing on your order.
For your protection, please send your return prepaid via a shipping service that can be tracked, such as UPS. Please be sure to keep your receipt. You understand that Optum cannot guarantee refunds for returns sent via a non-trackable method.
Credits are processed upon confirmation of the return by Optum’s suppliers. Please allow up to two billing cycles for the return credit to appear on your credit card.
VIOLATION OF THESE PURCHASE TERMS
You acknowledge that your access to this website and ability to purchase products and/or services offered herein shall be immediately suspended and may be terminated if you violate any provision of these Purchase Terms or the Terms of Use or Privacy Policy of myOptumHealthstore. You agree that a violation of any of these three policies by you will result in irreparable injury that will entitle Optum to obtain a court order prohibiting you from such access.
DISCLAIMERS
OPTUM MAY OFFER ACCESS TO SAVINGS ON PRODUCTS AND/OR SERVICES OFFERED ON THE WEBSITE THAT YOU MAY PURCHASE DIRECTLY FROM PAQUIN. ANY COMPLAINTS OR GRIEVANCES REGARDING THE PRODUCTS AND SERVICES OFFERED ON THIS SITE SHOULD BE ADDRESSED TO OPTUM. ANY COMPLAINTS OR GRIEVANCES REGARDING THE PROCESSING OF YOUR PAYMENT FOR ANY SUCH PRODUCTS OR SERVICES SHOULD BE ADDRESSED TO TRANSFIRST. OPTUM DOES NOT WARRANT OR GUARANTEE ANY SPECIFIC PRODUCT, SERVICE OR VENDOR. OPTUM MAY OR MAY NOT RECEIVE PAYMENTS FROM THESE VENDORS.
LIMITATION OF LIABILITY
EXCEPT AS PROHIBITED BY LAW, AND WITHOUT LIMITATION:
OPTUM SHALL NOT BE LIABLE FOR THE ACTS OR OMISSIONS OF PAQUIN, TRANSFIRST OR ANY OF THE VENDORS WHO OFFER PRODUCTS OR SERVICES ON THIS WEBSITE.
SURVIVAL
The provisions titled “CHARGES”, “RESPSONSBILITY FOR CHARGES AND APPLICABLE FEES”, “DISCLAIMERS” AND “LIMITATION OF LIABILITY” of these Purchase Terms will remain in effect after termination or suspension of your access to the website. You may terminate your use of the website at any time, however you will remain responsible for all charges you have incurred prior to your termination.
GOVERNING LAW
These Purchase Terms will be interpreted and construed in accordance with the laws of the State of Minnesota. Any action arising out of, or relating to, these Purchase Terms may be brought only in courts situated in Hennepin County, Minnesota, and you consent to the jurisdiction of such courts.
SEVERABILITY
To the extent possible, these Purchase Terms will be read together with any applicable statute or rule of law. Thereafter, if any of the terms and conditions of these Purchase Terms conflict with any applicable statute or rule of law, the affected terms and conditions will be deemed inoperative but the remaining portions will remain in full force and effect.
